98lite Preview Edition User License
1. OWNERSHIP
All rights, title and interests including, without limitation, copyrights, in and to 98lite
are exclusively owned and retained by the Author, Shane Brooks. All
rights not expressly licensed to you are retained and reserved by the
Author. The programs are not sold but are only licensed to you for use
strictly in accordance with the terms of this License and otherwise
remain the property of the Author.
2. USAGE
98lite Preview Edition is freely licensed for non-exclusive use
by a single individual for personal use only. You require an ENTERPRISE
license if you want to use 98lite in a multi-user setting, or want to install 98lite on your clients computers.
3. DISTRIBUTION
You may distribute the 98lite Preview Edition software without permission only so long as:
- the original distribution archive remains intact, with no files having been altered, added, or removed.
- all costs for distribution are paid by you, the distributor, and 98lite is delivered to the end user, or any intermediate receiver, FREE OF CHARGE.
- you acknowledge and disclose to the recipient that the distributed
files are unregistered and usage is dependent upon the acceptance of
the terms of this license.
4. THIRD PARTY LICENSING
98lite Preview Edition is an installer and feature customiser
for the Windows 98 and Windows Me operating system(s)produced and
licensed by Microsoft Corporation. Use of 98lite Preview
Edition applied in any of its configurations may invalidate any
guarantee and/or warranty provided in your Windows End User License
Agreement(s). Use of 98lite Preview Edition does not supersede
nor does it provide you any remedy for any guarantee or warranty that
may be invalidated by its
use. All liabilities from use or misuse of 98lite Preview Edition lie with you as the End User.
(tm) Windows 98 and Windows Me are trademarks of
Microsoft Corporation and are used by Author in a non-trademark,
descriptive sense only.
5. LIABILITY
THE AUTHOR AND HIS AGENTS AND/OR AFFILIATES DISCLAIM ALL WARRANTIES
WHETHER EXPRESS OR IMPLIED WITH REGARD TO THIS SOFTWARE INCLUDING,
WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT. AUTHOR DOES NOT
WARRANT THAT THE SOFTWARE OR DOCUMENTATION WILL SATISFY YOUR
REQUIREMENTS OR THAT THE SOFTWARE AND DOCUMENTATION ARE WITHOUT DEFECT
OR ERROR OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR
ERROR-FREE. IN NO
EVENT SHALL EITHER THE AUTHOR AND HIS AGENTS AND /OR AFFILIATES BE
LIABLE FOR ANY SPECIAL, PUNITIVE, INDIRECT OR CONSEQUENTIAL DAMAGES.
AUTHOR AND HIS AGENTS AND/OR AFFILIATES ARE NOT RESPONSIBLE FOR
BUSINESS INTERRUPTION, LOST PROFITS OR REVENUE OR SAVINGS, LOSS OF USE
OF THE SOFTWARE OR EQUIPMENT, LOSS OF DATA, COSTS OF RECREATING LOST
DATA, THE COST OF ANY SUBSTITUTE EQUIPMENT OR PROGRAM, OR CLAIMS BY ANY
PARTY OTHER THAN YOU OR ANY OTHER DAMAGES WHATSOEVER, WHETHER IN AN
ACTION OF CONTRACT,
NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION
WITH THE POSSESSION, USE OR PERFORMANCE OF THIS SOFTWARE. YOU AGREE
THAT YOU ACCEPT AND ASSUME FULL RESPONSIBILITY FOR (A) ALL RISKS
ASSOCIATED WITH THE USE OR PERFORMANCE OF AND (B) ANY LIABILITY
RESULTING FROM, THE SELECTION OF THE SOFTWARE AND FOR THE INSTALLATION,
USE, QUALITY, PERFORMANCE AND RESULTS OBTAINED FROM IT.
6. CANCELLATION
You may not use, copy, emulate, clone, rent, lease, sell, modify,
decompile, disassemble, otherwise reverse engineer, or transfer the
licensed program, or any subset of the licensed program, except as
provided for in this agreement. Any such unauthorized use shall result
in immediate and automatic termination of this license.
7. MANNER OF AGREEMENT/ACCEPTANCE
Retention, use of and/or installing 98lite Preview Edition
signifies your acceptance of the terms and conditions of this license.
If you do not agree to the terms of this license you should not
download or use the software and you must erase or otherwise destroy
all copies in your possession.
